End User License Agreement (EULA)

1. OWNERSHIP AND LICENSE MODELS: This Program is not sold to you ("User"), by MEPSS LLC, licensee of all rights and title to the code and accompanying documentation ("Program"). MEPSS LLC reserves all rights not expressly granted under this Agreement. MEPSS LLC hereby grants authorized Users a nontransferable, non-exclusive right to use the Program for official government purposes only under the following models: Free Use: Limited access granted to qualified government personnel and first responders as determined by MEPSS LLC. Paid Subscription: Enhanced access or extended service levels provided to authorized organizations upon payment of applicable subscription fees. Restrictions: Regardless of the use model, the Program may not be used for any personal, commercial, or activity that generates unauthorized monetary gains.

2. TERMINATION: MEPSS LLC shall have the right to terminate this Agreement and/or License without cause at any time. For Paid Subscriptions, termination may also result from failure to maintain current payment standing. If pre-paid subscriptions are canceled by MEPSS then a pro-rated refund for the remaining subscription duration will be provided upon request.

3. WARRANTY AND LIABILITY (AS IS) USER ACCEPTS THE PROGRAM ON AN "AS IS" BASIS. USER ACCEPTS THE PROGRAM ON AN "AS IS" BASIS. MEPSS LLC MAKES NO REPRESENTATION OR WARRANTY THAT THE PROGRAM WILL BE ACCESSIBLE OR DOWNLOADABLE. MEPSS LLC MAKES NO WARRANTY THAT ALL ERRORS CAN BE OR HAVE BEEN ELIMINATED FROM THE PROGRAM. MEPSS LLC SHALL NOT BE RESPONSIBLE FOR LOSSES OF ANY KIND RESULTING FROM THE USE OF THE PROGRAM AND ITS ACCOMPANYING DOCUMENT, AND CAN IN NO WAY PROVIDE COMPENSATION FOR ANY LOSSES SUSTAINED, INCLUDING BUT NOT LIMITED TO ANY OBLIGATION, LIABILITY, RIGHT, CLAIM OR REMEDY FOR TORT, OR FOR ANY ACTUAL OR ALLEGED INFRINGEMENT OF PATENTS, COPYRIGHTS, TRADE SECRETS, OR SIMILAR RIGHTS OF THIRD PARTIES, NOR ANY BUSINESS EXPENSE, MACHINE DOWNTIME OR DAMAGES CAUSED USER BY ANY DEFICIENCY, DEFECT OR ERROR IN THE PROGRAM OR MALFUNCTION THEREOF, NOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, HOWEVER CAUSED. MEPSS LLC DISCLAIMS ALL WARRANTIES, BOTH EXPRESS AND IMPLIED RESPECTING THE USE AND OPERATION OF THE PROGRAM AND ITS ACCOMPANYING DOCUMENTATION, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE AND ANY IMPLIED WARRANTY ARISING FROM COURSE OF PERFORMANCE, COURSE OF DEALING OR USAGE OF TRADE. MEPSS LLC MAKES NO WARRANTY THAT THE PROGRAM IS ADEQUATELY OR COMPLETELY DESCRIBED IN, OR BEHAVES IN ACCORDANCE WITH ANY ACCOMPANYING DOCUMENTATION. THE USER OF THE PROGRAM IS EXPECTED TO MAKE THE FINAL EVALUATION OF THE PROGRAM'S USEFULNESS IN USER'S OWN ENVIRONMENT.

4. DATA COLLECTION AND PRIVACY:

System Information: Technical data related to the User’s device configuration, including operating system type, version, license number, and client version, which may be collected to ensure technology compatibility and support.

Diagnostic Data: Incident-specific crash reports generated during system malfunctions.

User Responsibility: User is responsible for ensuring that any sensitive data entered into the Program is protected in compliance with applicable official government policies and standards. MEPSS LLC does not sell information collected in connection with these services.

5. PURPOSE AND USE OF COLLECTED DATA:

License Validation: To verify that the Program is being used by an authorized User for official government purposes only and to ensure compliance with the nontransferable, non-exclusive rights granted under this Agreement.

Usage Statistics: Frequency and duration of specific tool utilization (e.g., chemical lookup, calculator usage)

Anonymization and Organizational Mapping: The data collected is used solely for the purposes of internal validation, verification, and software mitigation. We do not collect or associate this technical data with a specific individual's name or email address. Instead, all telemetry is aggregated and associated at the Organizational level (e.g., your specific Fire Department or IT Agency) to identify site-specific technical requirements or training needs. EU Compliance and Purpose Limitation In accordance with EU data protection standards, this collection is limited to what is strictly necessary to provide a functional and secure service (Legitimate Interest). By using the application, you acknowledge that this telemetry is vital for maintaining the safety-critical software tools required for CBRNE event response and pre-planning.
